SPICe+ Part A is an online form used for reserving a company name in India under the Ministry of Corporate Affairs (MCA). It is part of the SPICe+ (Simplified Proforma for Incorporating Company Electronically Plus) initiative. This form allows applicants to check name availability before proceeding with company incorporation. The application is submitted through the MCA portal. A maximum of two proposed names can be submitted in a single application. The name should comply with the Companies Act, 2013, and naming guidelines. The chosen name should not be identical or similar to any existing company or trademark. A proper suffix like Private Limited or Limited must be included based on the company type. The applicant must provide the significance of the proposed name. The form is filed with basic details such as company type, sector, and state of incorporation. The Central Registration Centre (CRC) processes the application. If the name is unique and meets legal requirements, it is approved by CRC. If rejected, resubmission is allowed with alternative names. Approved names are reserved for 20 days for new companies. For existing companies, the name is reserved for 60 days. Once the name is approved, Part B of SPICe+ can be filled for incorporation. SPICe+ Part A can be filed separately or together with Part B. If filed separately, a fee of ₹1,000 is applicable for name reservation. If filed with Part B, no separate fee is required. The reserved name cannot be transferred to another entity. Applicants must ensure the name does not violate the Emblems and Names Act. If the name suggests government affiliation, approval from the respective department is required. Names containing words like “National,” “Bank,” “Stock Exchange,” and “Insurance” require additional approvals. Any misleading or offensive words are not allowed in the name. The MCA website provides a name availability tool to check potential conflicts. Using professional assistance helps in selecting an appropriate company name. If the name expires, a fresh application must be made. Name approval does not mean automatic company registration. If the incorporation process is not completed, the name becomes available for others. An incorrect or misleading application may lead to rejection or penalties.
